Passport and Co Terms and Conditions

Thank you for contracting your travel with Passport & Company, LLC (hereinafter “Passport & Co.” or “We”). As used herein, Passport & Co. shall include Passport & Co. and its members, managers, agents, subcontractors, employees, insurers, and parent and affiliate entities. Activities, as used herein, covered by this document include air, water, rail and ground transportation; hotel and other accommodations, restaurant reservations and other food and beverage packages, tours, sightseeing excursions and other services and activities, and any other recreational activities. Activities are operated and provided by various third-party suppliers and NOT by Passport & Co.. By booking your travel with Passport & Co., you and your travel companions agree to and are bound by the following terms and conditions:

 

A. DISCLAIMER OF LIABILITY: Passport & Co. is not the source or supplier of the requested travel related services or in accepting reservations or bookings for services that are not directly supplied by this travel agency (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.); it acts solely as an agent for the travel suppliers named in the proposal, itinerary or confirmation provided. You and your travel companions’ consent to and agree to the use of those suppliers named in the proposal, itinerary or confirmation provided. Passport & Co. does not have any special knowledge of the suppliers’ financial condition and are not liable to you or your travel companions in the event that the suppliers become insolvent. Furthermore, Passport & Co., shall not be responsible for any breach of contract or any intentional, reckless or careless actions or omissions on part of such suppliers, which result in any loss, damage, delay, or injury to you or your travel companions or group members. Unless the term "guaranteed" is specifically stated in writing on your tickets, invoice, or reservation itinerary, we do not guarantee any of such suppliers' rates, bookings, reservations, connections, scheduling, or handling of personal effects. Travel agent shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climatic conditions, criminal acts or abnormal conditions or developments, or any other actions, omissions, or conditions outside the travel agent's control. In addition, Passport & Co. has no knowledge of any dangerous conditions or travel advisories or restrictions at any destination beyond those that are listed on the website for the United States State Department, Travel Advisories. Traveler assumes complete and full responsibility for, and hereby releases the agent from any duty of, checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety or security conditions at such destinations, during the length of the proposed travel.

B. ASSUMPTION OF RISK:

1. 1. You and your travel companions acknowledge that there are significant elements of risk while traveling, either domestically within the United States or to foreign countries, participation in activities associated with water sports, the outdoors, the presence or use of motorized watercraft, and activities incidental thereto.
   2. You and your travel companions understand and agree that travel to foreign countries has inherent risk and that you and your travel companions assume all the risks associated with such travel and Activities including but not limited to forces of nature; terrorism; civil unrest; war; accidents; and transportation including land vehicles, boats, and aircraft that are not operated or maintained to standards found in the United States of America. You and your travel companions understand and assume the risks associated with altitude, illness, disease, physical exertion, known or unknown medical conditions, tainted food, and alcohol consumption, encounters with insects, or animals, exposure to the elements including heat, sun, water and wind; conditions in the water including tides, rip tides, animals; the negligence or lack of training of any agents or employees of the Passport & Co., your own negligence or the negligence of others including but not limited to the third-party suppliers and the entities providing the Activities and that access to evacuation and/or suitable medical supplies and support may not be available

   3. You and your travel companions acknowledge that exposure to viruses or diseases including but not limited to COVID-19 is an inherent risk of traveling that cannot be controlled or eliminated by Passport & Co..

   4. You and your travel companions acknowledge and assume the risk that certain criminal convictions may result in denial of entry to another country or boarding of ships or airplanes.
   5. You and your travel companions acknowledge and assume the risks inherent with the use and/or consumption of alcohol and/or drugs (whether illegal, legal and/or prescribed) that render you impaired.
   6. You and your travel companions acknowledge and assume the risks inherent with traveling with valuable items including but not limited to jewelry, important documents and papers and electronics.
   7. The Activities, by their very nature, carry with them certain inherent risks that cannot be eliminated regardless of the care and steps Passport & Co. or third-party suppliers who are operating and providing Activity(ies) have taken to avoid injuries. You and your travel companions acknowledge that the same elements that contribute to the unique character of these activities can cause loss or damage to my equipment, accidental injury, illness, or in extreme cases, permanent trauma, disability, or death.
   8. YOU AND YOUR TRAVEL COMPANIONS EXPRESSLY AND VOLUNTARILY ASSUME ALL RISK OF DEATH, ECONOMIC LOSS, DAMAGE TO PERSONAL PROPERTY OR PERSONAL INJURY SUSTAINED WHILE PARTICIPATING IN ACTIVITIES WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF Passport & Co.. You and your travel companions acknowledge and agree that your participation in an Activity(ies) is voluntary and that you and your knowingly assume all such risks, including those risks not specifically identified. You and your travel companions further understand that you are ultimately responsible for your own safety.
      

C. TRAVEL INSURANCE: Travel insurance is always recommended but is optional. There are different types of travel insurance; coverage and exclusions vary by insurance carrier. It is important that you understand the coverage and exclusions of the travel insurance. Passport & Co. does not provide advice or guidance on coverage or exclusions of travel insurance policies. Prior to purchasing or waiving travel insurance, it is your obligation to understand the coverage and exclusion of any travel insurance. Any information on travel insurance provided by Passport & Co. is provided by a third-party. Passport & Co. is not an insurance carrier or company and, therefore, does not offer or provide any advice or guidance on the coverage and exclusion of any travel insurance policy. You should contact the insurance carrier to obtain advice with respect to any particular coverage or exclusion of the travel insurance policy. Use of and access to the information using the above links does not create any duty between you and Passport & Co.. In the event that you do not elect to purchase travel insurance, then you hereby acknowledge that you understand that declining travel insurance could result in the loss of travel costs; require more money to address the situation; and/or there may be no means to recoup losses or additional costs.

D. MERCHANT OF RECORD: Passport & Co. is not the source or supplier of the requested travel related services or in accepting reservations or bookings for services that are not directly supplied by this travel agency (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.); it acts solely as an agent for the travel suppliers named in the proposal, itinerary or confirmation provided. You and your travel companions’ consent to and agree to the use of those suppliers named in the proposal, itinerary or confirmation provided. Furthermore, Passport & Co. is not the merchant of record for any of the requested travel-related services or components. The merchant of record for your bookings will be listed as the supplier on your invoices and statements.

E. PASSPORTS AND IDENTIFICATION: Everyone, including children and infants, MUST have a VALID passport to travel internationally (not Passport Card) or a government issued identification to travel within the United States. Failure to comply will result in denial of boarding, no refund, no exceptions (out of the USA). Passport & Co. is NOT responsible for passports or identification in ANY way. Passports are required to be valid for 6 months from your return date. PASSPORT CARDS ARE NOT VALID FOR TRAVEL INTERNATIONALLY VIA AIR!

F. ENTRY AND EXIT REQUIREMENTS FOR INTERNATIONAL TRAVEL: Due to variations by country and the ever-changing nature of these entry and exit procedures and requirements for international travel, it is your responsibility to ensure that you are compliant with any requirements imposed at your destination as well as the United States. To assist you, we recommend that you consult the US State Department's website as well as the government's website for your destination. In addition, it is your responsibility to ensure that you have knowledge and understand the information about your destination provided by the United States’ Centers for Disease Control and Prevention.

In addition, by booking your travel with Passport & Co., you and your travel companions acknowledge, understand and agree:

1. 1. That it is your responsibility to know and understand the vaccination requirements (including but not limited to COVID vaccination) for your chosen destination; and
   2. That the chosen destination may implement vaccination requirements and entry/exit requirements after booking and that Passport & Co. is not obligated to notify of such and that you may not be entitled to change or cancel your booking without penalties (up to and including no refunds) as a result even if you have purchased travel insurance; and
   3. That the United States may implement requirements for air travel (both domestic and international) as well as re-entry requirements and that Passport & Co. is not obligated to notify of such and that you may not be entitled to change or cancel your booking without penalties (up to and including no refunds) as a result even if you have purchased travel insurance; and
   4. That if you do not have the required vaccinations for travel to the selected destination (including but not limited COVID vaccination), that you will not be allowed to travel and that you may not be entitled to change or cancel your booking without penalties (up to and including no refunds) as a result even if you have purchased travel insurance; and
   5. The risks associated with traveling without being vaccinated (including but not limited to COVID vaccinations);
   6. That you will not present falsified vaccination or testing results;
   7. That you will follow all masking, testing and social distancing requirements of any of the providers (including but not limited to airports, airlines, resorts, hotels, transportation, and dining establishments) without disruption;
   8. That you may be denied entry to another country or boarding of ships or airplanes due to certain criminal convictions.

G. REFUSAL OF ENTRY, BOARDING, SERVICES AND EXPULSION. You understand and agree that each provider reserves the right to refuse entry, boarding, service and to expel you from the Activity(ies) for certain conduct and/or behaviors including but not limited to engaging in unsafe conduct, illegal conduct, conduct that jeopardizes the health and safety of yourself and/or others; alcohol or drug impairment; failure to follow the Activity’s code of conduct, rules and safety precautions. You further acknowledge that you understand and agree that you will not be entitled to any refund or credit for any unused portions of your Activities and that additional costs will be incurred to address the particular situation including but not limited to additional transportation costs, additional costs for accommodations and costs of alternative flights and, in the event that you purchased travel insurance, it is unlikely that these costs will be covered by the travel insurance.

H. SERVICE FEES FOR CHANGES, CANCELLATIONS AND ADDITIONAL SERVICES: We reserve the right to charge fees up to ten percent (10%) of the total cost of the booking for services rendered in the event that you elect to change and/or cancel your reservations, which must be paid prior to any changes or cancellations processed. We also reserve the right to charge fees for other services related to your travel including but not limited to arranging tours, excursions, transportation, special requests/needs and dining, which must be paid prior to the additional services being rendered.

I. CHANGES TO RESERVATIONS: ANY changes made to your existing reservations are subject to the current rates, promotions, and terms at the time of change.

J. FINAL PAYMENT: Passport & Co. recommends final payments are made 7 days prior to the deadline. Payments cannot be processed during non-business hours or on holidays. Please allow 48 hours for your travel agent to process your payment.

All reservations are subject to cancellation and penalties as described above if final payment is not received on the due date. Failure to pay on time is not covered by the travel insurance. The trip cannot be retrieved and must be re-booked based on space available and current prices. In addition, any payment previously made on the reservation, including but not limited to the deposit, may be non-refundable and is subject to the terms and conditions of the suppliers

K. CANCELLATION, PENALTIES AND REFUNDS: Passport & Co. is not the source or supplier of the requested travel-related services or in accepting reservations or bookings for services that are not directly supplied by this travel agency (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.). Accordingly, you and your travel companions are bound by the terms and conditions including those terms and conditions about cancellation, penalties and refunds of those suppliers. In addition, in the event that you cancel your booking for any reason, then Passport & Co. shall charge a cancellation fee in the amount of ten percent (10%) of the total cost of the booking for services rendered, which must be paid directly to the travel agent PRIOR to any cancellation being processed.

L. BAGGAGE FEES: Due to continual changes in airline baggage policies it is suggested that you inquire with your airline's website for up-to-date fees & information. Passport & Co. is NOT responsible for additional fees incurred for baggage or seating. BAGGAGE FEES ARE NOT PART OF AN ALL-INCLUSIVE PACKAGE.

M. TSA REGULATIONS: You must abide by TSA regulations when traveling by air. To answer any questions you might have regarding airline regulations and the specifics with the latest security policies, please visit www.tsa.gov or call (866) 289-9673. 

N. AIRLINE SCHEDULE CHANGES & CANCELLATIONS: Airlines may change flight schedules or cancel flights. Passport & Co. is NOT responsible for any additional costs or fees imposed by the airlines due to any changes in schedules or flight cancellations. It is the responsibility of the passenger to check for last minute airline flight time changes within 24 hours of departure. Passport & Co. is not responsible for changes that may occur within 24 hours of original flight departure time. In addition, you may find more information about your options as a passenger at https://www.transportation.gov/airconsumer/fly-rights.

O. NOTICE OF SPECIAL NEEDS OR ASSISTANCE OR DISABILITY: Any disability and/or condition requiring special attention or accommodation must be reported to and requested from Passport & Co. prior to booking. Passport & Co. will make reasonable efforts to accommodate the special needs of disabled clients but is not responsible for any denial of services by carriers, hotels, lodges, restaurants, or other independent suppliers, nor any additional expenses incurred. Transportation typically is not equipped with wheelchair ramps. In addition, the providers of the Activities typically cannot provide individual assistance for walking, dining, getting on/off motor coaches and other vehicles, or other personal needs.

P. DIETARY AND ALLERGY NEEDS: Any dietary and allergy requests must be reported to Passport & Co. prior to booking. It is your responsibility to ensure that you notify the providers of your transportation, accommodations and food and drink of your dietary and/or allergy needs; however, those requests cannot be guaranteed.

Q. CHOICE OF LAW AND VENUE: This Agreement, and the rights and obligations of the parties hereunder, shall be interpreted, construed, enforced and governed by Missouri law, without regard to the choice of law rules of Missouri. Any claims relating to the interpretation or enforcement of this Agreement may be brought only in the District Court of Jackson County, Missouri or the U.S. District Court for the District of Missouri.
